Terms Of Service

These terms of service ("terms") cover your use and access to our service, client software and websites (hereby known as "service"). The Service is provided by Telenor Software Lab AS, a company registered in Norway, with company registration number 884 640 202. Our Privacy Policy explains how we collect and use your information while our acceptable use policy explains how we expect you to use our service. By using the service, you agree to comply to these terms, including our privacy policy and our acceptable use policy. Please read these carefully. The service is provided to individual consumers for private use. The service shall not be used for commercial purposes, unless a prior written agreement has been signed.

Description of the Service

Mine Papirer is an internet based storage service that allows you to store, see and annotate electronic documents. You will be able to add and view these documents on a selection of supported handheld devices.

You own your content

When you use our service, you may submit, download and view your own digital content. This content belongs to you. We do not have access to your content, except for what is required to maintain a safe and secure service.

To provide this service, we will need to process the content for backup purposes. We will also need to process the content, and tailor the result, in order for the content to be accessible on all supported devices; for preview, facilitating annotation, sorting, editing, and searching.

You will appreciate that we take a firm position in protecting your content from unauthorised access. In order to prevent unlawful use and access, we implement security mechanisms that monitor content and traffic between devices and servers. You should be aware that any malicious content registered by the detection system will be reported to the police or relevant authorities.

We will only provide access to persons that are legally authorized to gain access to the content. If you desire someone else getting access to your content (also after you have deceased), you will have to share your login credentials, or you will need to document this in your will and testimony. Be aware that credential sharing is not recommended, as it compromises security!

Note: Where multi factor authentication is used, a specific device may be used for verification exclusively. In such case, you will no longer be able to rely on password sharing alone. We therefore recommend that you create a will and testament.

Paying for the use of the service

The service is offered on a monthly subscription basis. You may find further information on pricing and payment options within the app.

Your Responsibilities

You are responsible for your actions! Your Content and your actions must comply with our Acceptable Use Policy. Content in the Services may be protected by others' intellectual property rights. Please don't copy, upload or download content unless you have the right to do so.

We may review your actions for compliance with these Terms and our Acceptable Use Policy. With that said, we have no obligation to do so. We aren't responsible for the content people post and share via the Services. We do not access Your Content unless we are required by law.

You are responsible for providing and maintaining accurate and updated personal information, and for safeguarding your account information. To keep the Content secure you need to protect this with your own secret. Due to the sensitivity of Your Content the secret should be selected in such a way that other persons cannot guess it, or "brute force" its content. You may not select or use an identity of another person with the intent to impersonate that person. You must use a valid e-mail address, and we reserve the right to verify this at any time. You are not allowed to have more than one account per e-mail address. Please make sure that you log out when using public or shared devices. If you hand over a device with the service installed to another individual, you should log out of the service and/or deactivate the device before doing so. If devices with the service installed are lost or stolen, you should change the password immediately and contact customer service to remotely log out your devices. Do not share your account credentials or give others access to your account! We will never ask you for such details. We will not be liable for any loss or damage arising from your failure to comply with these requirements.

You may use our Services only as permitted by applicable law, including export control laws and regulations.

Software

The Service allows you to download client software ("Software") which may update automatically. As long as you comply with these Terms, we give you a limited, nonexclusive, nontransferable, revocable license to use the Software, solely to access the Services. Unless the following restrictions are prohibited by law, you agree not to reverse engineer or decompile the Services, attempt to do so, or assist anyone in doing so.

Our rights

The Services are protected by copyright, trademark, and other laws. The trademarks, logos, domain names and any other similar signs or symbols which are displayed on the Website or as part of the Service are the registered and unregistered marks of Telenor Software Lab AS. Nothing in the Terms grants you the right to use any such marks. These Terms do not grant you any right, title or interest in the Services, others' content in the Services, trademarks, logos and other brand features.

Copyright

By your use of the Service we ask that you respect the intellectual property rights of others as we do. We respond to notices of alleged copyright infringement if they comply with the law. We reserve the right to delete or disable content alleged to be infringing and to terminate such accounts as we see fit.

Support

You are always welcome to contact Mine Papirer support. Most questions will be answered within 24 hours.

Termination

You may stop using the Service at any time. The Service may be terminated by contacting Mine Papirer support. When you terminate the service all your data will be deleted within 30 days and cannot be recovered after this.

If you act in breach of the Terms or applicable laws, your right to use the Service and access its content will immediately, without notice, terminate or suspend without refund of any fees. We may also discontinue or stop providing the Service to you, or add limits to your Service.

When appropriate, we will provide you with reasonable advance notice via the email address associated with your account to remedy the activity, and to provide information on how to export Your Content from our Services. It is Your responsibility to follow up on these actions, before the service is rendered unreachable.

We won't provide notice before termination where:

• you're in material breach of these Terms.
• doing so would cause us legal liability or compromise our ability to provide a safe and secure service to other persons.
• we're prohibited from doing so by law.

Disclaimer

The Service is provided "as is". You acknowledge that the Service is not error-free. We make no warranties, expressed or implied, with respect to the availability, merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, performance and quality of the Service. The Service will from time to time have to carry out updates and maintenance of the Service, due to technical, security or operational reasons, during which time the Service might be unavailable. Telenor Software Lab will make reasonable efforts to arrange updates and maintenance outside of peak usage hours.

The Website and the Service may contain links to third party websites. These links are provided solely as a convenience to you and not as an endorsement of the contents of such third-party websites. The Service does not take responsibility for the content of linked third party websites. You should carefully review the terms of use and privacy statements of all websites that you visit.

Limitation of Liability

Except as otherwise required by law, we (including, our affiliated companies, partners and their contractors, officers, directors and employees) shall have no liability for damages under these Terms, howsoever caused whether arising under law, contract, warranty, indemnification, tort or otherwise, including, without limitation, incidental and consequential damages, loss of profits or business opportunities, or damages resulting from loss of data or loss of access to the Service. In any event, Telenor Software Lab's total liability shall not exceed the amount paid by you for the Service during the last 12 months prior to the incident.

Changes

We are constantly changing and improving our Service. We may add or remove functionalities, feature and content and we may suspend or stop a Service. We may also update or otherwise amend the Terms, for instance to reflect changes to the Service or changes to the law. The amendments will not have retroactive effect. We will publish any amended Terms on the Website. Material changes will be notified more prominently to the e-mail you are registered with. The amendments will enter into force when published on the Website or otherwise when communicated to you in an appropriate manner. Your continued use of the Service after such publication or notification is considered as an acceptance of the amended Terms. We encourage you to check the Website regularly. If you do not agree to the amendments, you should discontinue your use of the Service. We are entitled, in whole or in part, to assign our rights and obligations under the Terms to a third party at our own discretion.

Resolving Disputes

We will try to resolve any questions or concerns you may have following your contact to our support desk. Should we not be able to solve a dispute to an acceptable solution to both parties you or we may file judicial proceedings. Except where otherwise required by law, these Terms shall be governed by and interpreted in accordance with Norwegian law. Any dispute, controversy or claim arising out of or in connection with the Terms shall be subject to the jurisdiction of the Norwegian courts with the district court of Asker & Bærum, Norway as the legal venue.

Acceptable Use Policy

You are responsible for the lawfulness of Your Content. The Service should not be used for any Content which, without limitation:

• is offensive, such as User Content that engages in, endorses or promotes racism, bigotry, discrimination, hatred, harassment or physical harm of any kind against any group or individual
• involves the transmission of "junk mail", "chain letters" or unsolicited mass mailing, "spamming" or "phishing"
• promotes or endorses false or misleading information or illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous
• promotes or endorses an illegal or unauthorised copy of another person's copyrighted work
• links to pornographic, sexually explicit or any other indecent material
• violates the rights of or harms or threatens the safety of other users or the Service
